IRS Sending ACA Penalty Letters for Tax Year 2015

As previously noted in the Tip of the Week, the IRS has begun sending Letter 226J for tax year 2015 informing ALEs (Applicable Large Employers (those with 50 or more full-time equivalent employees)) of their potential liability for any employer shared responsibility payment.
For monthly myHRcounsel clients who receive such a letter, a consultation with one of their attorneys regarding the letter is included in your subscription. Forms-only clients can also receive a consultation.
MyHRcounsel is also here to help you file a formal response with the IRS and appearing in the appeals process. While this is not included in the monthly subscription or forms production service, they will provide these services at a reasonable hourly charge, working with their tax counsel and accounting partners to work through this new and likely burdensome process. If you’re looking for assistance with a formal response and appeal and would like to know more about myHRcounsel services, please contact your Strategic Account Executive.
If you were an Avionté ACA package client in 2015 and need to reprint your ACA forms, please utilize the 1095 C Report 2015 and 1094 C Report 2015 to do so. If you do not see the reports, you may need a Superuser to grant access in Admin Tools > Reports
If you need assistance with accessing the 2015 report data, please create a Support Center ticket with the subject line of “ACA Penalty”. As timeliness is of the utmost importance when responding to the IRS, entering “ACA Penalty” in the subject line of your ticket will ensure we are able to work your ticket promptly and help you gain access to the necessary reports.
